TERMS & CONDITIONS

PAYMENT:  Payment for conveyances shall be cash or check with proper photo identification.  Full payment shall be made on day of sale before leaving premises.  All checks must be made payable to Watson Auction Service, LLC.  Buyer agrees not to stop payment for any reason as all sales are final.  We will not accept drafts.  Non Sufficient Funds checks will be subject to a $100.00 Administrative Charge and prosecution where applicable.

10% BUYERS PREMIUM:  All sales will be subject to a 10% buyer’s premium to help defray the cost of the auction.  The bid price plus the buyer’s premium will equal the total contract sale price.

WARRANTY:  All conveyances are sold “As Is, Where Is! with no warranty expressed or implied”  The Auctioneer assumes no liability for any guarantee made by the seller.  No warranty is made by the Auctioneer, either expressed or implied, as to the condition, merchantability, or fitness for intended use of any conveyance sold.  It is agreed that the buyers have thoroughly examined the property to be conveyed and relies solely upon his/her own judgment in making an agreement to purchase, and that there are no agreements, understandings or representations made either by seller, Auctioneer or Auctioneer’s representatives that are not set forth herein.

POSSESSION AND TITLE:  Possession of or title to conveyances will not be relinquished to the buyer until the buyer’s payment has cleared the bank.  Anyone paying cash can take possession of the conveyance on the day of sale with title being issued within 30 days.

DISPUTES BETWEEN BUYERS:  The Auctioneer shall designate the purchaser after each item of merchandise is sold.  If a dispute arises between two or more buyers, the Auctioneer reserves the right to reopen bidding.  His designation of a buyer shall be final.

RESALE:  Auctioneer reserves the right to resell any property not paid for in full on day of sale.  The buyer shall be responsible to Auctioneer for any expenses for resale or collections and any damages resulting from sale.

SALES TAX, PURCHASES BY DEALER FOR RESALE, ETC.:  All sales are subject to sales tax laws of the State of Alabama.  It will be necessary on sale day to execute a Certificate of Resale for all purchases to be resold.  This certificate must bear your sales tax permit number.  Failure to furnish this information will require payment of sales tax on all purchases.

STATEMENTS MADE BY AUCTIONEER ON DAY OF SALE TAKE PRECEDENCE OVER THIS OR ANY OTHER PROMOTIONAL MATERIAL.
