FIREARMS TERMS & CONDITIONS

PROHIBITED ACTS: Private treaty sales will not be allowed.  This is an Auction and not a gun show.  Anyone wishing to sell a firearm should contact Watson Auction & Realty, LLC at 334.596.2312. No private treaty sales will be allowed at the auction or on the auction grounds.

PAYMENT:  Payment for purchases shall be cash or check with Government Issued Photo Identification, VISA OR MASTERCARD ONLY ($100.00 minimum purchase for using credit cards).  We DO NOT ACCEPT DISCOVER nor AMERICAN EXPRESS! Credit Card purchases of less than $200.00 will incur a 3% upcharge. Full payment shall be made on day of sale before leaving premises.  All checks must be made payable to Watson Auction & Realty, LLC.  Buyer agrees NOT to stop payment for any reason on all check(s) given to Watson Auction & Realty, LLC for settlement of auction purchases as all sales are final.  Watson Auction & Realty, LLC WILL NOT accept drafts.  Non Sufficient Funds checks will be subject to a $100.00 Administrative Charge and prosecution where applicable.

10% BUYERS PREMIUM:  All sales will be subject to a 10% buyer’s premium to help defray the cost of the auction.  The bid price plus the buyer’s premium will equal the total contract sale price.

WARRANTY:  All items sold “As Is, Where Is!”  The Auctioneer assumes no liability for any guarantee made by the seller.  No warranty is made by the Auctioneer, either expressed or implied, as to the condition, merchantability, or fitness for intended use of any property sold.  It is agreed that the buyers have thoroughly examined the property to be conveyed and relies solely upon his/her own judgment in making an agreement to purchase, and that there are no agreements, understandings or representations made either by seller, Auctioneer or Auctioneer’s representatives that are not set forth herein.

REMOVAL DATE:  Merchandise (other than firearms) becomes the full responsibility of Buyer at the time of purchase and Buyer assumes all risk of loss or damage to property until removed from sale premises.  All Property must be removed from premises on day of sale unless other arrangements are made with Watson Auction & Realty, LLC.

DISPUTES BETWEEN BUYERS:  The Auctioneer shall designate the purchaser after each item of merchandise is sold.  If a dispute arises between two or more buyers, the Auctioneer reserves the right to reopen bidding.  His designation of a buyer shall be final.

RESALE:  Auctioneer reserves the right to resell any property not paid for in full on day of sale.  The buyer shall be responsible to Auctioneer for any expenses for resale or collections and any damages resulting from sale.

INJURY & DAMAGES:  Bidder acknowledges responsibility for and assumes liability for any personal injury and property damage caused by bidder or his agent and further agrees to hold Auctioneer harmless for any personal injury to himself or his agents and any property damage incurred on sale premises.

SALES TAX, PURCHASES BY DEALER FOR RESALE, ETC.:  All sales are subject to sales tax laws of the State in which auction is held.  It will be necessary on sale day to execute a Certificate of Resale for all purchases to be resold.  This certificate must bear your sales tax permit number.  Failure to furnish this information will require payment of sales tax on all purchases.

TRANSFER LOCATION FOR NON-LICENSEE’S: I am a federal firearms licensee.  Before any firearm is transferred into your possession, you will have to fill out a 4473 and pass a background check.  All background checks, transfers and related actions will have to be completed at our office located at 654 Lynn Jarvis Road, Dothan (Kinsey), Alabama.  

POSSESSION OF FIREARMS:  You will not be able to take possession of the firearms until the next day at the earliest.  Qualified Firearms Dealers may take possession of firearms at the auction if they provide the proper documentation, i.e. FFL, Business License, Resale Tax Certificate, etc. Possession of the firearms will not take place until your payment has cleared the bank.  If you pay by cash or credit card, we can convey the firearm as soon as possible after you fill out the appropriate paperwork and pass the background check on the day after the auction.

FELONS:  If you are a convicted felon, even if you have had your right to vote restored, you may not be able to own or possess firearms.  Please do not bid on these weapons unless you have been issued a possessory number by the BATF.

SHOTGUNS & RIFLES:   We can convey long guns to you in the State of Alabama if you are from another state, provided that the long gun being conveyed is legal in the state where you reside.

HANDGUNS: If you are from a state other than the State of Alabama, we cannot transfer a handgun to you.  You will have to give me the name and contact information for a federal firearms licensee in your area, and I will transfer the handgun to the licensee and he will have to transfer it to you.  That licensee may charge you an additional fee for that service.  This does not apply to long guns.

DOMESTIC VIOLENCE OR RELATED OFFENSES:  If you have ever been convicted of a crime involving domestic violence, whether it was a misdemeanor or felony, you may not possess firearms under Federal Law.  If you are currently under a restraining order or charges of any kind related to a domestic situation, you may not possess firearms under Federal Law.

POSSESSION OF PURCHASED FIREARMS:  You will not be given possession of firearms purchased until your payment has cleared the bank.  If you pay cash, we can convey the weapon as soon as possible after you fill out the appropriate paperwork and pass the background check.

RESIDENCE: If you are military personnel from another state and your permanent duty station is in the State of Alabama, I can transfer the weapon to you with a copy of your orders stating that Alabama is your permanent duty station along with Government Issued Photo Identification.

CITIZENS/NON-CITIZENS: If you are not a citizen of the United States, it is incumbent upon you to be sure that you are in compliance with all federal requirements for firearms ownership prior to bidding on any firearms.

BACKGROUND CHECK STATUS DENIED:  If you purchase a weapon and are denied, you cannot bring someone else in to get a background check done.  The background check is on the bidder only.  If you are the successful high bidder and are denied on the background check, we reserve the right to place the firearm in the next available auction event and will resell it for you.  You will be charged a 25% commission on the sale under these circumstances and if you make a profit, that’s your good luck…if you do not; too bad, so sad.
