Personal Property Terms & Conditions


WARRANTY:  All items sold “As Is, Where Is!”  The Auctioneer assumes no liability for any guarantee made by the seller.  No warranty is made by the Auctioneer, either expressed or implied, as to the condition, merchantability, or fitness for intended use of any property sold.  It is agreed that the buyers have thoroughly examined the property to be conveyed and relies solely upon his/her own judgment in making an agreement to purchase, and that there are no agreements, understandings or representations made either by seller, Auctioneer or Auctioneer’s representatives that are not set forth herein.

PAYMENT:  Payment for purchases shall be cash or check with Government Issued Photo Identification, Visa, MasterCard, Discover or American Express. Credit Card purchases will incur a 3% Convenience Fee.  Full payment shall be made on day of sale before leaving premises.  All checks must be made payable to Watson Auction & Realty, LLC.  Buyer agrees NOT to stop payment for any reason on all check(s) given to Watson Auction & Realty, LLC for settlement of auction purchases as all sales are final.  Watson Auction & Realty, LLC WILL NOT accept drafts.  Insufficient Funds checks will be subject to a $100.00 Administrative Charge and prosecution where applicable.

10% BUYERS PREMIUM:  All sales will be subject to a 10% buyer’s premium to help defray the cost of the auction.  The bid price plus the buyer’s premium will equal the total contract sale price.

SALES TAX, PURCHASES BY DEALER FOR RESALE, ETC.:  All sales are subject to sales tax laws of the State in which auction is held.  It will be necessary on sale day to execute a Certificate of Resale for all purchases to be resold.  This certificate must bear your sales tax permit number.  Failure to furnish this information will require payment of sales tax on all purchases.

REMOVAL DATE:  Merchandise becomes the full responsibility of Buyer at the time of purchase and Buyer assumes all risk of loss or damage to property until removed from sale premises.  All Property must be removed from premises on day of sale unless other arrangements are made with Watson Auction & Realty, LLC.

DISPUTES BETWEEN BUYERS:  The Auctioneer shall designate the purchaser after each item of merchandise is sold.  If a dispute arises between two or more buyers, the Auctioneer reserves the right to reopen bidding.  The Auctioneer’s designation of a successful high bidder shall be final.

RESALE:  Auctioneer reserves the right to resell any property not paid for in full on day of sale.  The buyer shall be responsible to Auctioneer for any expenses for resale or collections and any damages resulting from sale.

INJURY & DAMAGES:  Bidder acknowledges responsibility for and assumes liability for any personal injury and property damage caused by bidder or his agent and further agrees to hold Auctioneer harmless for any personal injury to himself or his agents and any property damage incurred on sale premises.
